Third DWI Charge Goes to Man Passed Out Behind Wheel at Schnucks

Ladue Police found the man in the grocery store parking lot at the wheel with the engine running.

Ladue Police said they found a man passed out behind the wheel of his car with the engine running in a parking lot at 8867 Ladue Road at 2:51 a.m. Friday.

Jeremiah Maples, 25, of St. Louis, was charged with DWI as a persistent offender. It was his third DWI charge since 2005. He pleaded guilty to one of the charges last August.

Ladue Police said officers woke Maples up. The officers said his eyes were bloodshot and water, he slurred his speech and could not stand without assistance. He was unable to perform a sobriety field test and refused a breathalyzer test.

Police obtained a search warrant to take a breathalyzer but did not release the results.

Maples is being held in St. Louis County jail in lieu of a $10,000 bond.

He pleaded guilty to DWI Aug. 7 for an incident that occurred April 17, 2010. Maples also was convicted of a DWI on Jan. 3, 2008 for an incident on Dec. 8, 2005.

If he was sleeping and not driving then how could he be charged. Could these DWI laws be unconstitutional?

My brother, once representing a client in Jackson, Michigan beat the case the same way. No proof he was drinking and driving since he was passed out, alongside the road.

I had a friend who felt he was too drunk to drive home and curled up in his backseat, but it was the middle of winter, so he left the engine running. He got cited for DWI because the key was in the ignition. Not sure how he was any danger when he was asleep in the back seat. He lost in court. Of course, It was Madison County, so anything is possible.

Generally if you're in the driver's seat with the keys, you're going DWI.

And does anyone really think he neither drove drunk to the Schnucks nor would have driven upon waking up? I know we all try to think of technicalities when threatened with jail, but this guy was a drunk in a car, all ready to go back out on the road and maybe kill some nice innocent person.
